These website Terms are separate from any direct funding contract or independent provider agreement. Draft for legal review before public use.

1. Website and operator

These Terms apply to lkcapitals.com (the “Site”), operated under the LK Capitals name for pre-settlement legal funding inquiries. They govern use of the Site, not the terms of any funding transaction. If you do not agree, please do not submit an inquiry.

2. Direct funding and independent referrals

LK Capitals may review and fund certain eligible legal claims directly. In other cases, and only when the applicant authorizes partner sharing, LK Capitals may introduce the inquiry to an independently operated litigation-funding provider. A participating provider is responsible for its own underwriting, contracts, funding decisions and related obligations. We do not promise that a partner will review or accept any particular case.

3. Partner relationships and possible compensation

LK Capitals may receive referral, placement, or broker compensation from a participating funding provider in a transaction where such compensation is permitted by applicable law. Any applicable relationship, compensation paid by the applicant, and identity of the funding company should be explained before a funding agreement is signed. Submission of this form does not itself create a payment obligation to LK Capitals. We do not pay attorney or medical-provider referral fees where prohibited.

4. Availability by state

LK Capitals accepts preliminary inquiries concerning legal claims in the United States but does not offer funding or intermediary services in states where the particular activity is not available or legally permitted. Eligibility, permissible activities, licensing or registration, disclosures, rates, charges and other requirements depend on the relevant state and transaction. A submission is not a commitment to offer funding in your state.

5. No guarantee; separate written contract

Any funding offer is subject to case review, available capital or provider participation, applicable law and a separate written agreement identifying the provider, funding amount, fees, charges, repayment obligations and other terms. Any treatment of a transaction as non-recourse depends on the terms of that actual agreement. Website information cannot modify an executed agreement.

6. Legal representation and independence

LK Capitals is not a law firm and does not offer legal, tax or financial advice. Applicants should consult their own attorney before agreeing to legal funding. Neither LK Capitals nor participating funding providers should direct litigation strategy, settlement or attorney selection contrary to applicable law. We may request attorney information and appropriate permission before contacting counsel.

7. Application details and partner-sharing choice

Applicants must submit accurate information and have authority to provide it. We request only basic inquiry details on the initial form. Partner referrals are optional: a “Yes” selection authorizes us to share the specified initial inquiry details with eligible independent funding providers to evaluate possible funding options; a “No” selection keeps the initial inquiry with LK Capitals and its service providers. Additional documents and attorney information may require separate authorization. Do not enter Social Security numbers, banking passwords, detailed medical files or privileged communications in the initial website form.

8. Communications

Submitting the form requests contact regarding the inquiry using the provided phone number or email address. This does not by itself authorize unrelated marketing texts, automated marketing calls or sale of your details. Where separate consent is required, it must be obtained separately. Phone, email or other communication may be subject to ordinary carrier or service charges.

9. Privacy and independent provider practices

How LK Capitals processes your initial application is described in our Privacy Policy. An independent funding provider that receives information pursuant to your permission may have its own privacy notice and terms. You should read those terms before completing any subsequent application or signing any funding documents.

10. Cash advances via external website

The cash-advance link takes you to Golden Cash Advance, which is a separate website. Its business funding products, application, policies and bank-verification process are not governed by these LK Capitals Site Terms.

11. Acceptable use and site limitations

You may not provide misleading identity information, impersonate another person, interfere with the Site, or attempt unauthorized access. Although we aim to keep the Site accurate and available, information may change and Site access can be interrupted. Nothing in these Terms waives protections that applicable law does not permit us to waive.

12. Revisions

We may revise these website Terms and will post an updated date. Any executed funding contract continues to be governed by its own terms.

13. Governing Law and Court Venue

These website Terms are governed by the laws of the State of Florida, except where mandatory law of another jurisdiction applies. To the extent permitted by applicable law, disputes arising solely from use of this website that may properly be heard in court will be brought in the state courts located in Miami-Dade County, Florida, or, where federal jurisdiction exists, the appropriate federal court serving Miami-Dade County, Florida. Nothing in this provision overrides mandatory jurisdiction or venue requirements, nonwaivable consumer rights, or the dispute-resolution provisions of a separately executed funding agreement. This website provision does not itself create an arbitration agreement.
