Getting Started
What is pre-settlement lawsuit funding?
Pre-settlement funding is an arrangement that may allow someone with a pending legal claim to receive funds before the claim is resolved. Funding terms vary by provider, case, and applicable law. Any actual advance will be governed by a separate written agreement.
Does LK Capitals provide the money directly?
LK Capitals considers some eligible cases for direct funding. For other inquiries, we may offer to connect the applicant with an independent funding company, but only if the applicant authorizes that referral and it is legally permitted.
How do I apply for lawsuit funding?
Complete our secure online inquiry form or call (305) 525-3939. We will review your case details and determine what additional information or documents may be needed. Submitting an inquiry does not guarantee approval or an offer.
Do I need an attorney to apply?
Attorney representation is generally necessary to complete a pre-settlement funding review and arrangement. You may still submit an inquiry if you are looking for representation, but funding may not be available until an attorney is handling your case.
What types of cases may qualify?
We primarily review personal injury claims, including automobile, motorcycle and truck accidents, slip-and-fall cases, and other potentially eligible lawsuits. Other case types may be considered individually; neither direct funding nor partner availability is guaranteed.
Is lawsuit funding available in my state?
LK Capitals accepts inquiries from different U.S. states, but funding can be offered or arranged only where permitted by applicable law. State licensing, registration, disclosure, and other requirements may affect availability. We verify eligibility before making or referring any offer.
Eligibility and Application Review
What information will you need about my case?
We generally start with your name, contact information, state, type and status of legal claim, attorney information, and requested funding amount. With appropriate authorization, we or a participating provider may request additional case-related documentation from you or your attorney. Please do not include medical records or sensitive financial information in the initial message field.
Does my lawsuit have to be filed already?
Some funding reviews may consider claims before a lawsuit has formally been filed, while others require a pending court case. Eligibility depends on the funding provider, stage of the claim and applicable law.
Will you check my credit score or employment?
Legal funding decisions generally focus on the case and expected recovery rather than traditional loan underwriting. However, verification requirements vary by provider and product. We will explain any checks or authorizations requested as part of the review.
Can my application be declined?
Yes. Applications may be declined because of case status, uncertain liability, estimated recovery, insufficient documentation, existing funding obligations, legal restrictions or other underwriting factors. We cannot guarantee approval.
Can I request more funding later?
You may submit another inquiry if your case circumstances change. Any additional funding request is evaluated separately, including any previous advances and obligations.
Funding Amounts, Costs and Repayment
How much funding could I receive?
The amount, if any, depends on the nature and strength of your claim, projected recovery, existing liens or funding, and the terms available from LK Capitals or an independent provider. We do not promise a fixed percentage of the potential settlement.
How quickly can I receive funds?
Most approved cases can be funded within 24 business hours after attorney verification, receipt of required documents, and completion of the funding agreement. Timing can vary depending on the case and funding provider, so funding within that timeframe is not guaranteed.
How much does pre-settlement funding cost?
Costs can vary by case and funding provider. Before accepting an offer, review the amount to be advanced, all fees or charges, how the amount due may change over time, and any repayment cap. These details belong in the written funding agreement. LK Capitals does not promise any universal rate or repayment cap on this website.
Do I owe money if my case is unsuccessful?
Many pre-settlement funding arrangements are nonrecourse, meaning repayment generally depends on a successful recovery. Whether that applies, and any legally permitted exceptions such as fraud or contract breach, must be confirmed in the specific agreement offered to you. Never assume the same terms apply to every provider or case.
Will I have monthly payments?
Nonrecourse lawsuit funding typically involves repayment from case proceeds rather than ordinary monthly installments. Your proposed written agreement will control the actual payment obligations and conditions.
What can I use the funds for?
Applicants often seek help with everyday expenses while a case is pending. Permitted uses depend on the applicable funding agreement and law. Ask about any restrictions before accepting funds.
Partners, Attorneys and Privacy
Will my information be sent to other funding companies?
Only if you choose the partner-referral option in our application or otherwise give appropriate authorization. If you select direct review only, LK Capitals will not refer your inquiry to an independent funding provider under that form authorization. See our Privacy Policy for additional information.
What happens if you refer my case to a partner?
With your permission, we may share the basic information you provided with a participating independent provider to evaluate potential funding. The partner makes its own approval decision and will provide its own contract, terms and privacy disclosures. LK Capitals may receive referral compensation where legally permitted.
Will my attorney be involved?
An attorney may need to confirm details about your case and participate in any funding arrangement. You should review all proposed funding costs and obligations with your attorney. LK Capitals is not a law firm and does not provide legal advice.
Am I required to accept a funding offer?
No. Sending an inquiry does not obligate you to accept any offer. Read the agreement carefully and ask questions before signing.
